He wasn't coming to give himself up. He had already given himself up and been taken into custody at the end of a huge battle in New York. When he was shot he was being taken into a courthouse, I think to be arraigned. That was in either New York or D.C.; I'm not actually sure which, because I haven't read the issues immediately surrounding his death.

Heh. Complicated question. He was shot the first time by a sniper named Crossbones, in the shoulder, I think. The kill shots were delivered by a mind-controlled Sharon Carter. She was being mind-controlled by Dr. Faustus, who is in league with the Red Skull, and those two were also responsible for Crossbones's sniper shot.
Red Skull and Faustus are both still on the loose and have capture Sharon and are holding her. I have no idea how much the public knows about what happens or if Crossbones was captured--if he was captured, he got loose again, because he appeared again in a recent issue of Captain America.
